General Terms and Conditions (GTC)

General Terms and Conditions (GTC)

of Softly Said GmbH, Währinger Straße 168/20, 1180 Wien, Österreich, FN 661766k (Handelsgericht Wien), VAT ID ATU82603979, email: office@softly-said.com (hereinafter “we” or the “Seller”).

1. Scope of application

These GTC apply to all orders placed by consumers within the meaning of the Austrian Consumer Protection Act (Konsumentenschutzgesetz, KSchG) via our online shop softly-said.com. Any conflicting terms and conditions of customers shall not become part of the contract.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the “Buy now” or “Order with obligation to pay” button, you submit a binding order for the goods contained in your shopping cart. Confirmation of receipt of the order is sent by email immediately after submission. The purchase contract is concluded upon this order confirmation, or at the latest upon shipment of the goods. The text of the contract is stored; the order data will be sent to you by email. The language of the contract is German.

3. Prices and shipping costs

All prices stated are in euros and include statutory VAT. Any additional shipping costs will be shown during the ordering process before the order is placed.

4. Payment

Payment is made using the payment methods offered during the ordering process. The purchase price is due upon conclusion of the contract.

5. Delivery

Delivery is made to the delivery address you have provided. Information on delivery times can be found with the respective product or during the ordering process. If an item is not available, we will inform you without delay; any payments already made will be refunded promptly in this case.

6. Retention of title

The goods remain our property until full payment has been received.

7. Right of withdrawal

Consumers have a 14-day right of withdrawal pursuant to the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). Details, exceptions, and the model withdrawal form can be found in our Right of Withdrawal notice.

8. Warranty

The statutory warranty provisions of Austrian law apply. If you have a complaint about defects, please contact office@softly-said.com.

9. Liability

We are liable without limitation for damages arising from injury to life, body, or health, as well as in cases of intent and gross negligence. In cases of slight negligence, we are liable only for breach of material contractual obligations, and the amount of liability is limited to the foreseeable damage typical for this type of contract. Mandatory statutory liability provisions (in particular under the Product Liability Act) remain unaffected.

10. Applicable law and place of jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). With respect to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory consumer-protection provisions of the law of the country of their habitual residence. The statutory places of jurisdiction remain unaffected.

11. Dispute resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact office@softly-said.com.

12. Final provisions

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
